Ukrainians explained the legal consequences of a fictitious marriage.


The Ministry of Justice reported that if a marriage is contracted without the intention of forming a family, it is considered fictitious by court decision. This means that if one or both parties in the marriage do not intend to create a family, the marriage can be declared invalid.
In such cases, intention is determined by non-legal factors such as the desire to live together, manage a household together, care for the family's well-being, and other similar matters. If actual behavior after the marriage registration indicates the existence of intention, then the marriage will not be recognized as fictitious.
An invalid marriage does not grant individuals who were registered in this marriage the rights and obligations of spouses. However, if joint property was acquired during the actual period of being in an invalid marriage, it is considered joint ownership. Additionally, a person who lived in the partner's housing in an invalid marriage may be evicted.
It is important to note that a fictitious marriage can have criminal consequences, such as fraud or evasion of military conscription.
